Abstract
This study was carried out to analyze the tendency of the domestic legal systems on green roof, compare it with the international and draw direction for the future improvements for activating and improving green roofs eco-friendly. The results show that the Building Law and the Urban parks and green spaces Act include the direct recording related to green roof while the Law on Land use planning only has the indirect. And the Biotope area factor plays an important role to indicate green roof and needs on the legal basis. Among the Metropolitan cities, Incheon and Busan have regulatory support of relatively detailed provisions regarding to the type(M1), and Seoul, Gwangju, Ulsan, and Deajeon have briefly mentioned provisions regarding to the type(M2). In the regulation of provincial and local governments, green roof is regarded as a kind of green spaces and the brief supporting content is included. In the foreign cases, there are not any national laws recording green roof directly but local governments’ regulations have recording legal and financial supports which include ratio of green roof, green building standard, density bonusing, direct grants and etc. In conclusion, the domestic legal system for green roof should be improved by emphasis on the district or urban scale, and the climatic and urban support programs which could reflect the specific characteristics should be established for local governments.
